Distance Sales Agreement

Article 1. Parties

BUYER: the registered user (tenant/organisation administrator or doctor) who purchases a package/subscription electronically through the UzmanHekim platform.

Article 2. Definitions

Platform: all websites and applications offered under the uzmanhekim.az domain. Package/Service: the digital rights of use sold for a fee on the Platform. PayTR: the payment institution through which payments are collected.

Article 3. Subject of the agreement

This Agreement governs the sale and performance of the digital service ordered electronically by the Buyer, together with the parties’ rights and obligations. The Buyer declares that they have read and accepted this Agreement before confirming the purchase.

Article 4. Service, price and means of payment

The type, scope (e.g. doctor quota, facility/landing rights, number of users), duration and US-dollar price of the service are shown clearly on the checkout page; all amounts including taxes are valid at the time of purchase.

Payment is made by card through the secure PayTR infrastructure. Card details are neither seen nor stored by the Seller.

Article 5. General provisions and Buyer declarations

The Buyer declares that the information provided at registration is accurate and current, is responsible for the confidentiality of their account credentials, and will use the Platform only for lawful purposes.

Article 6. Performance and delivery

The service is electronic and is performed by assigning it to the Buyer’s account immediately after payment confirmation (within 24 hours at the latest). There is no physical delivery. See the Delivery Terms page for details.

Article 7. Right of withdrawal

Where permitted by law, before performance begins the Buyer may withdraw from the contract within 14 days without giving any reason and without penalty, by sending a written notice to the contact details below.

Article 8. Cases where the right of withdrawal does not apply

For digital services performed instantly in electronic form, where performance has begun with the Buyer’s consent, the right of withdrawal may not be exercised. Accordingly, once a package is activated (performance begun), the right of withdrawal may not apply to the used period. Article 9. Intellectual property rights

All rights in the Platform and its content belong to the Seller. The Buyer is granted only a personal, non-transferable, non-exclusive licence to use the service. The Buyer may not copy, reproduce or reverse-engineer the Platform software, nor use the Seller’s brand/logo/name without permission.

Article 10. Limitation of liability

The Platform is provided “as is”. While the Seller aims for 24/7 availability, it does not warrant uninterrupted or error-free operation. The Seller’s total liability under this Agreement is in all cases limited to the amount paid by the Buyer for the relevant service.

Article 11. Protection of personal data

The Seller processes and protects personal data in accordance with applicable data-protection law. Data required for payment is shared only with the payment institution (PayTR) for the purpose of completing the transaction.

Article 12. Term and termination

This Agreement enters into force upon the Buyer’s electronic acceptance. A subscription is valid for the purchased period and does not auto-renew. Termination does not affect rights and obligations accrued up to that date.

Article 13. Dispute resolution and competent court

The Buyer first contacts the Seller at [email protected]. If unresolved, Turkish law applies and the Balıkesir Mahkemeleri ve İcra Daireleri have jurisdiction.
